Infrastrutture Lombarde Spa, un vero affare? Quanto ci costa?
Mi ricollego al convegno organizzato presso il Parlamento europeo su iniziativa dell'On. Gottardi in data 8 maggio 2007 sul caso Infrastrutture Lombarde S.p.A. per alcune brevi considerazioni.
Ho notato che le perplessità sollevate in quella sede si sono appuntate in modo particolare sul tema della mancata garanzia di libera concorrenza, che sarebbe preclusa dal ricorso alle c.d. "società in house".
In realtà credo che il problema sia un altro, posto che la giurisprudenza - anche comunitaria - ha ritenuto legittimo il ricorso all' "in house" in materia di appalti in presenza di due requisiti: controllo analogo a quello esercitato sui propri uffici da parte dell'ente di riferimento e rapporto di esclusività tra costituente e costituito.
Queste due situazioni mi pare ricorrano nell'ambito del rapporto tra Regione Lombardia e Infrastrutture Lombarde S.p.A..
