view of the law October 26, 1995, No 447, entitled "Framework Law on Noise Pollution";
the Order of the President of the Council of Ministers on 1 March 1991 fixing the maximum exposure to noise in residential areas and the outside environment;
Given the favorable opinion by the Conference permanente per i rapporti tra lo Stato, le regioni e le province autonome, nella seduta del 20 marzo 1997;
Considerata la necessità di armonizzare i provvedimenti in materia di limitazione delle emissioni sonore alle indicazioni fornite dall'Unione europea;
Sulla proposta del Ministro dell'ambiente, di concerto con il Ministro della sanità;
Decreta:
Art. 1
Campo di applicazione
1. Il presente decreto, in attuazione dell'art. 3, comma 1, lettera a) della legge 26 ottobre 1995, n. 447, determina i valori limite di emissione, i valori limite di immissione, i valori di attenzione ed i valori di qualità, di cui all'art. 2, comma 1, lettere e), f), g) ed h); comma 2; comma 3, lettere a) e b), della stessa legge.
2. I valori di cui al comma 1 sono riferiti alle classi di destinazione d'uso del territorio riportate nella tabella A allegata al presente decreto e adottate dai comuni ai sensi e per gli effetti dell'art. 4, comma 1, lettera a) e dell'art. 6, comma 1, lettera a), della legge 26 ottobre 1995, n. 447.
Art. 2
Valori limite di emissione
1. I valori limite di emissione, definiti all'art. 2, comma 1, lettera e), della legge 26 ottobre 1995, n. 447, sono riferiti alle sorgenti fisse ed alle sorgenti mobili.
2. I valori limite di emissione delle singole sorgenti fisse di cui all'art. 2, comma 1, lettera c), della legge 26 ottobre 1995, n. 447, sono quelli indicati nella tabella B allegata al presente decreto, fino all'emanazione della specifica norma UNI che sarà adottata con le stesse procedure del presente decreto, e si applicano a tutte le aree del territorio ad esse circostanti, secondo la rispettiva classificazione in zone.
3. I rilevamenti e le verifiche sono effettuati in corrispondenza degli spazi utilizzati da persone e comunità.
4. I valori limite di emissione del rumore delle sorgenti sonore mobili di cui all'art. 2, comma 1, lettera d), della legge 26 ottobre 1995, n. 447, e dei singoli macchinari costituenti le sorgenti sonore fisse, laddove previsto, sono altresì regolamentati dalle norme di omologazione e certificazione delle stesse.
Article 3

1. The absolute limit values \u200b\u200bas defined under clause input. 2, paragraph 3, letter a) of the Law of 26 October 1995, n. 447, related to noise in the environment includes all external sources are those listed in Table C attached to this decree.
2. For road, rail, sea, airport and other sound sources in art. 11, paragraph 1, reads Oct. 26, 1995, No 447, the limits set out in Table C attached to this Order shall not apply within their respective ranges of relevance, identified by its decrees. Outside these bands, these sources contribute to the achievement dei limiti assoluti di immissione.
3. All'interno delle fasce di pertinenza, le singole sorgenti sonore diverse da quelle indicate al precedente comma 2, devono rispettare i limiti di cui alla tabella B allegata al presente decreto. Le sorgenti sonore diverse da quelle di cui al precedente comma 2, devono rispettare, nel loro insieme, i limiti di cui alla tabella C allegata al presente decreto, secondo la classificazione che a quella fascia viene assegnata.
Art. 4
Valori limite differenziali di immissione
1. I valori limite differenziali di immissione, definiti all'art. 2, comma 3, lettera b), della legge 26 ottobre 1995, n. 447, sono: 5 dB per il periodo diurno e 3 dB per il periodo notturno, all'interno degli housing environments. These values \u200b\u200bdo not apply in areas classified in Class VI in Table A attached to this decree.
2. The provisions in the preceding paragraph shall not apply in the following cases, as any effect of noise is considered negligible
a) if the noise measured at the open windows is less than 50 dB (A) during daytime and 40 dB (A) during night;
b) if the ambient noise level measured with closed windows is less than 35 dB (A) during daytime and 25 dB (A) during night.
3. The provisions of this Article shall not apply to noise produced:
- by road, rail, airport and sea
- activities and behaviors are not related to production needs, commercial and professional
- from fixed building services and facilities used for common use, only for the disturbance caused in the same.
Article 5 of the Transport Infrastructure
1. The absolute limit values \u200b\u200bfor intake and exhaust for the individual transport infrastructure, within their respective ranges of relevance, and its extension, will be fixed by the respective decrees, in consultation with the Permanent Conference for relations between the State, regions and autonomous provinces.
Article 6

1. The values \u200b\u200bof attention expressed as the equivalent continuous sound pressure level weighted "A", which refer to time in the long term (TL) are:
a) when referring to one hour, the values \u200b\u200bin Table C attached to this decree, an increase of 10 dB for the day period and 5 dB for night time;
b) regarding time reference, the values \u200b\u200bin Table C attached to this decree. The time in the long term (TL) is the period in which you want to have the characterization of the territory from the standpoint of environmental noise. The length of this period is related to changes in factors affecting such a noise in the long term. The TL value, multiple of the period reference, is a period of time covering the periods that allow the evaluation of specific local realities.
2. For the adoption of action plans under Article. 7 of Act Oct. 26, 1995, No 447, is sufficient to overcome one of the two values \u200b\u200bmentioned in paragraphs a) and b) of Section 1 above, except for purely industrial areas in which action plans should be adopted in case of exceeding the values \u200b\u200bin b ) above.
3. The values \u200b\u200bof care referred to in paragraph 1 shall not apply to local bands attributable to road, rail, ports and airports. Article 7
quality value
1. The values \u200b\u200bof quality in art. 2, paragraph 1, letter h) of Act Oct. 26, 1995, No 447, are shown in Table D annexed to this decree.
Article 8 Transitional provisions
1. While waiting for the municipalities to fulfill the obligations laid down in Article. 6, paragraph 1, letter a) of the Law of 26 October 1995, n. 447, apply the limits of art. 6, paragraph 1 of the Decree of President of the Council of Ministers on 1 March 1991.
2. Exceeding the limits set out in paragraph 1 above, involves the adoption of sanctions under Article. 10 of the Law of 26 October 1995, n. 447, except as provided in paragraph 5 of that article.
3. Until the issue of Decree Ministerial in art. 3, letter c) of Act Oct. 26, 1995, No 447, instrumentation and procedures for noise measurement are set forth in Annex B of the Decree of President of the Council of Ministers on 1 March 1991.
Repeals Section 9
1. With effect from the entry into force of this decree shall be eliminated paragraphs 1 and 3 of art. 1 of the Decree of President of the Council of Ministers on 1 March 1991.
Article 10 Entry into force
This decree will be published in the Official Gazette of the Italian Republic and will enter into force thirty days after its publication.

CLASSE I - aree particolarmente protette: rientrano in questa classe le aree nelle quali la quiete rappresenta un elemento di base per la loro utilizzazione: aree ospedaliere, scolastiche, aree destinate al riposo ed allo svago, aree residenziali rurali, aree di particolare interesse urbanistico, parchi pubblici, ecc.
CLASSE II - aree destinate ad uso prevalentemente residenziale: rientrano in questa class urban areas mainly affected by local traffic, with low population density, limited business presence and absence of industrial activities and crafts.
CLASS III - Areas of mixed type: This class includes urban areas affected by local or through traffic, with average population density, the presence of businesses, offices with limited presence in craft and with the absence of industrial activities ; rural areas affected by activities that use machines.
CLASS IV - areas of intense human activity fall into this class urban areas affected by intense traffic, with high densità di popolazione, con elevata presenza di attività commerciali e uffici, con presenza di attività artigianali; le aree in prossimità di strade di grande comunicazione e di linee ferroviarie; le aree portuali, le aree con limitata presenza di piccole industrie.
CLASSE V - aree prevalentemente industriali: rientrano in questa classe le aree interessate da insediamenti industriali e con scarsità di abitazioni.
CLASSE VI - aree esclusivamente industriali: rientrano in questa classe le aree esclusivamente interessate da attività industriali e prive di insediamenti abitativi.
